The Competition Commission of India (CCI)

The Competition Commission of India has been established by the Central Government with effect from 14 October 2003. The Commission currently sits with a Chairperson and not less than 2 and not more than 6 Members appointed by the Central Government. 

It is the duty of the Commission to eliminate practices having adverse effect on competition, promote and sustain competition, protect the interests of consumers and ensure freedom of trade in the markets of India. Investigations are carried out by the Office of the Director General (DG), a department of the CCI.

The Commission must also give opinion on competition issues on a reference received from a statutory authority established under any law and undertake competition advocacy, create public awareness and impart training on competition issues.

When the Competition Act 2002 was enacted there was no mention of any Competition Appellate Tribunal. It was only after the filing of the Brahm Dutt v. Union of India case that the Competition (Amendment) Act 2007 provided for the establishment of the Competition Appeals Tribunal, the CompAT. To streamline the enforcement of justice in India, the Finance Act 2017 tranferred appeals against the decisions of the CCI to the National Company Law Appellate Tribunal (NCLAT), a specialized court which was already the appellate body against decisions of the National Company Law Tribunal and of the Insolvency and Bankruptcy Board of India. The substantive provisions of the Competition Act relating to appeals remain however unchanged. The CompAT ceased operating on 26 May 2017, date from which the NCLAT has taken over.
