The prohibition

Section 53 of the EEA Agreement prohibits agreements between undertakings, decisions by associations of undertakings and concerted practices which are restrictive of competition. The list of prohibitions contained in Section 53 applies to practices which:

- directly or indirectly fix prices, discounts, margins or any other trading conditions,

- limit or control production, markets, technical development, or investment,

- apply dissimilar conditions to equivalent transactions with other trading parties, thereby placing them at a competitive disadvantage,

- make the conclusion of contracts subject to acceptance by the other parties of supplementary obligations which, by their nature or according to commercial usage, have no connection with the subject of such contracts.

The EEA Agreement provides for both individual and group exemptions. Undertakings may apply for an exemption where the agreement or concerted practice in question fulfills certain conditions. In essence, these conditions are identical to those set out in the corresponding provision in Section 101 (3) TFEU. Annex XIV of the EEA agreement states the EU exemption regulations are applicable in the EEA Member States.
