Cease and desist order

If the EU Commission or the ESA find that there has been an infringement to Sections 53 or 54 of the EEA Agreement, they shall propose appropriate measures to bring it to an end. Pursuant to Section 53 (II) of the EEA Agreement, any agreement in violation of the EEA Agreement is deemed to be void.

       The ESA and the EU Commission may impose fines and periodic penalty payments to be paid by undertakings for infringements of Sections 53 or 54 of the EEA Agreement. Fines may be set to an amount up to 10% of the infringing companies' turnover. The ESA has adopted a series of (non-binding) notices and guidelines on different aspects of the competition rules, like guidelines on the method of setting fines, or a notice on immunity from fines and reduction of fines in cartel cases. These notices and guidelines take account of similar instruments adopted by the European Commission.

  Pursuant to Section 5 of the 1996 Act, administrative fines or penalty payments shall be imposed by the Office of Economic Affairs where the EFTA Surveillance Authority or the EU Commission authorize Liechtenstein to adopt remedial measures. The level of administrative fines must not exceed CHF 10,000 (EUR 8,350). Penalty payments must not amount to more than CHF 2,000 (EUR 1,660) for each day of default.
