Civil and criminal sanctions

Under Article 36 of Act No 104-12, the Competition Council may order the parties to put an end to the anticompetitive practices within a specific period of time. If the parties involved fail to comply with injunctions or commitments made binding by the Competition Council, it may impose a fine of up to 4 million [US$ 413,000] dirhams where they are not undertakings or of up to 10% of their global turnover when they are.

Under Article 106 of Act No 104-12, authorized consumer organizations may bring civil actions unrelated to the harm suffered by consumers.

Besides, the Act provides for criminal sanctions. 

Any natural person who, fraudulently or knowingly participates personally in the conception, organization, the implementation or the control of practices referred to in Articles 6 and 7 may be punished with imprisonment of between two months to one year (previously two years) and a fine of between 10,000 to 500,000 dirhams (US$ 1,085 to US$ 54,300) or one only of those sanctions (Article 75).

Obstruction to investigations or refusal to supply information requested by the investigators or the supply of false information is sanctioned by an imprisonment of between two months to two years and a fine of between 5,000 to 200,000 dirhams (US$ 543 to 21,715) or one only of those sanctions (Article 83). Legal persons may also be held jointly and severally liable with their directors (Article 88).
