Exemptions

The Act defines “dominant position” as the power of one or more undertakings in a particular market to determine economic parameters such as price, supply, the amount of production and distribution, by acting independently of their competitors and customers (Section 3).

Section 6 of the Protection of Competition Act provides that abuse of a dominant position of an undertaking or through agreement of undertakings, within the whole country or just a part of it, is prohibited, including, inter alia:

- impeding the activities of competitors, especially new ones;

- imposing dissimilar conditions to similarly positioned purchasers;

- subjecting agreements to conditions outside usual business terms;

- distorting competitive conditions in another market by means created by dominance in a particular market; or

- restricting production to the detriment of consumers (for further details on the determination of a dominant position and which conduct constitutes an abuse, practitioners should refer to the Guidelines on the Assessment of Exclusionary Abusive Conduct by Dominant Undertakings of 29 January 2014, No 14-05/97-RM(1)).
