   Where a party fails to notify and the Board subsequently becomes aware of the transaction and determines that it violates Section 7, the Board has the authority, in addition to any fines, to suspend the transaction and order its reversal.

According to Section 16 of the Act, a fine of up to 0.1% of the undertakings' annual turnover may be imposed for failure to notify an acquisition or merger within a specified period where such notification is compulsory, for gun-jumping or for the provision of false or misleading information in the notification form. The minimum fine may not be lower than TRY 31,903 (EUR 3,600). 

If, the transaction falls within the prohibition of Section 7 and creates or strengthens a dominant position and causes a significant lessening of competition, the companies involved may be ordered to pay a fine of up to 10% of their Turkish turnover generated in the financial year preceding the date of the decision on fines.
