Context

The competition process in Ukraine is mainly governed by the Law of Ukraine No. 2210-III on Protection of Economic Competition of 2001 ("the Competition Act"), the procedural provisions of which were lastly amended on September 2021 and the Law No. 3659-XII on the Antimonopoly Committee of Ukraine of 1993 ("the AMC Act"), updated in 2021.

In addition, specific pieces of legislation govern state aids (Law No. 1555-VII on State Aid to Undertakings), bids (Law No. 1197-VII on Public Procurements) and unfair competition practices (Law No. 236/96 on Protection against Unfair Competition).

On 1st January 2024, Law No. 3295-IX of 9 August 2023 on Amendments to Certain Legislative Acts of Ukraine to Improve the Activities of the Antimonopoly Committee of Ukraine entered into force and reformed Ukrainian competition law. The law inter alia aims to strengthen the powers of the AMC.

According to Article 2 of the Competition Act applies to such relations that ensue from or can have an impact on economic competition in the territory of Ukraine. It governs relations of bodies of the State, bodies of local government, bodies of administrative and economic management and control and relations of economic entities with other economic entities, consumers, other legal and natural persons in connection with economic competition.
