53. Control criteria

A concentration is deemed non-permissible when it does significantly impede effective competition in the Belgian market or in a substantial part thereof, in particular through the creation or strengthening of a dominant position (Section IV.9, § 4 CDE). In examining the admissibility of the concentration, the competition authority must take into account: “1º the need to maintain and develop effect …
