Scope

Competition in Cyprus is governed by the Protection of Competition Law of 2022 (the Competition Act) which replaced the former Protection of Competition Laws of 2008 and 2014. The new Act was designed to harmonize Cypriot law with Directive (EU) 2019/1 of the European Parliament and of the Council of December 11, 2018 in order to empower the competition authorities of the Member States to be more effective enforcers and to ensure the proper functioning of the internal market.  

The Competition Act applies to restrictive trade agreements and practices, and abuse of dominance, under the monitoring of a Commission for the Protection of Competition.

It applies to undertakings which the 2014 defines as any entity engaged in an economic activity regardless of its legal status and method of financing.

Pursuant to Section 7 of the Act, the following are not considered as coming within the provisions of the law:

- agreements relating to wages and terms of employment and working conditions;

- undertakings entrusted with the operation of services of general economic interest or having the character of a state monopoly, to the extent that the application of the Act would prevent the achievement of the objective assigned to them by the State.
