The Market Court (Markkinaoikeus)

Act No 661/2012 merged the previously independent Finnish Competition Authority (FCA) and the Consumer Agency into the Finnish Competition and Consumer Authority (FCCA) which has been operative since 1st January 2013. However, the Act did not alter the main functions and powers of the previous FCA. 

Like the FCA, the FCCA operates under the control of the Ministry of Trade and Industry. It is made up of one Director General, assisted by two directors, one responsible for competition matters, the other responsible for consumer-related matters and who endorses the functions of the Consumer Ombudsman. Other personnel and civil servants are appointed by the Director General.

  The FCCA examines competition restrictions and takes measures to eliminate them and their harmful effects. It handles exemptions and monitors and investigates competition conditions.

  The FCCA also follows the preparation of the economic legislation and issues statements about questions related to its field.

On 27 January 2022, the FCCA published updated guidelines on the application of the Competition Act in leniency cases, i.e. in the immunity from penalty payment and  reducing the penalty paiement in cartel cases where a cartel memeber reveals the existence of a cartel or delivers new information on the cartel to the competition authority. The update is based on the ECN+ directive which harmonized the relevant legislation in the European Union. 

The Finnish Competition and Consumer Authority - FCCA (Kilpailu- ja kuluttajavirasto)

Under the Act on the Market Court (Act No 1527/2001), effective 1 March 2002, jurisdiction over all competition law and procurement matters previously handled by the Competition Council has been transferred to a new Market Court. In addition, the Market Court also assumes the responsibilities of the former Market Court. The Market Court is made up of one Chief Judge and Market Court judges, assisted by expert members and “referendaries”.

  Upon the recommendation of the Finish Competition and Consumer Authority (FCCA), the Market Court may prohibit the implementation of a restrictive agreement and impose a penalty payment (Section 12). It also hears appeals against certain decisions of the FCCA.

The Provincial State Office, under Article 2 of Decree No 66/1993, must operate under the guidance of the Finish Competition and Consumer Authority in issues involving the protection of sound economic competition.
