Appeals against judgments of the specialized courts

The Paris Court of Appeal has exclusive jurisdiction for judicial review of the Authority's decisions. An appeal must be brought within one month of the adoption of the decision by the Competition Authority (L. 464-8 CC), except where the decision concerns interim measures. In that case the appeal must be lodged before the Paris Court of Appeal at the latest ten days after notification of the Authority's decision (L. 464-7 CC). The Paris Court of Appeal may uphold, modify in part or reverse the decision de l'Autorité. It may classify the infringements differently, increase or reduce the administrative fine. Appeals on points of law may then be brought by the parties to the action before the Court of Cassation (Cour de cassation) within a month of the judgment of the Paris Court of Appeal.

Appeals against the decisions of the Competition Authority

Actions relating to anticompetitive or unfair practices are brought before specialized commercial or civil courts (D. 420-3, D. 442-2 and D. 442-3 CC). These decisions may only be appealed before the Paris court of appeal. However, when a claim has unduly been brought and judged before a non-specialized court, the appeal must be lodged before the ordinary competent court, but the latter will only be allowed to annul the judgement and, as the case may be, rule on issues not related to the application of Article L. 442-1 (Court of Cassation, 29 March 2017, LawLex201700000598JBJ). Appeals on points of law against the judgment of the Paris Court of Appeals may be taken to the Court of Cassation.
