Under Section 54 GWB, the FCO may institute proceedings ex officio or upon application. Thus, parties recognized as having a right to apply for an exemption for example, may start proceedings before the FCO. More generally, parties having a personal interest (subjektives Recht), in a matter arising under the Act, may apply to the FCO to instigate proceedings.
