Fines

Clearance may be granted subject to conditions and obligations. Under the new provisions of the GWB resulting from the 8th Amendment of June 2013, merger clearance can now not only be subject to structural remedies, but also to behavioral remedies. However, they should not impose a monitoring burden on the FCO (for more details, practitioners should refer to the FCO's Merger Remedies Guidelines of 30 May 2017).

A concentration that has been put into effect and that is subsequently prohibited or has its clearance revoked must be dissolved (Section 41(3) GWB) unless it has been authorized by the Federal Ministry for Economic Affairs and Energy.

Conditions and commitments - Divestiture
