The courts

The Hungarian Competition Authority (HCA) is the authority responsible for enforcing the Competition Act (Section 33(2)). It is headed by a President, appointed for a renewable six-year term by the President of the Republic upon nomination by the Prime Minister. To strengthen the independence of the HCA and guarantee the integrity of its members, Sections 34 et seq. institute stricter rules regarding qualification requirements, wages, post-term activities, etc. In addition, on 15 July 2020, the HCA revised its organizational rules in order to confer more control over the functioning of the Authority on the President and increase the institution's accountability.

The HCA is divided into a decision-making body, the Competition Council, headed by a vice-president of the HCA and members, including investigators. According to Section 48 of the Act, decisions of the Competition Council are taken by a panel of three members or sometimes five when deemed necessary and appropriate. The Chair of the Competition Council is responsible for, inter alia, organizing the activities of the Competition Council, drawing up the operational rules of the Council and ensuring publication of Council decisions. The investigators are responsible for the day-to-day running of investigations.

In order to implement the ECN+Directive, Act XIX of 2020 now provides that the HCA may set priorities for more efficient use of its resources in carrying out the tasks related to supervising competition.
