Appeals against actions of investigating officers

    Under Section 32 illegal actions of investigating officers can be appealed to the Competition Council. A complaint must be brought within 10 days of the date of the acts which are the subject of the appeal. The Competition Council must take a decision within 10 days of receipt of the complaint.

The Vilnius Regional Administrative Court is the body competent to hear appeals against decisions of the Council. According to Section 33 of the Act, undertakings as well as other persons who believe that their rights under the Competition Act have been violated are entitled to appeal. Appealable decisions include the Competition Council's resolutions which prevent any further investigation of the violation of the Act, decisions handing down sanctions or on the contrary, decisions which refuse to impose sanctions and decisions to terminate the procedure for absence of breach of the Act. However, purely procedural decisions may not be subject to an appeal.

Parties must lodge their written complaint no later than within one month from the publication or from the date of service of the Council's decision. The appeal does not work to suspend the decision of the Council, except where the latter decides to suspend the collection of the fine.
