The Malta Competition and Consumer Affairs Authority Act 2011 (Chapter 510 of the Laws of Malta) established a new authority which took over the functions previously entrusted to the Office of Fair Competition, the Department of Consumer Affairs, the Malta Standards Authority and the Malta National Laboratory Company Limited. The new Malta Competition and Consumer Affairs Authority (MCCAA) is composed of a Board of Governors, a Co-ordination Committee and four entities: the Office for Competition, the Office for Consumer Affairs, the Standards and Metrology Institute and the Technical Regulations division. Each of those entities is headed by a Director General.

Within the MCCAA, the Office for Competition headed by its Director General, is entrusted, inter alia, to act as the national competition authority in Malta as designated by virtue of Article 35(1) of Council Regulation (EC) No 1/2003.

Thus, the 2011 Act significantly increased the role of the Office for Competition by conferring on it not only investigative powers as the Office of Fair Competition previously enjoyed but also decision-making powers, therefore granting it a status very similar to the European Commission's under Regulation No 1/2003. This status reverted back in 2019: following two Constitutional Court rulings of 2016 and 2018, the Office was deprived of the power to impose fines and became a prosecution authority, which must refer cases investigated to the Civil Court (Commercial Section).
