Appeals against decisions of the Court of Competition, Regulation and Supervision

Decisions of the Competition Authority may be appealed before the Court of Competition, Regulation and Supervision of Santarem (Section 84(3)).

Prohibition decisions may be the subject-matter of an extraordinary appeal before the Minister in charge of economic affairs where the benefits of the transaction for the fundamental strategic interests of the national economy are higher than the detriment to competition (Section 41 of the Competition Authority Statutes). The appeal must be lodged within 30 days of the notification of the decision. Upon proposal from the Minister in charge of economic affairs, the Council of Ministers may authorize the merger, subject to conditions and commitments aimed at minimizing its detrimental effects on competition.

In accordance with Law 17/2022, the statute of limitations can be extended indifinitely while judicial appeals are pending. Moreover the period for lodging an appeal against the Portuguese Competition Authority's final decision has been extended to 60 business days. Judicial Appeals are only able to suspend by providing 50% of the fine as security.
