Scope

After the fall of the communist regime, the former Czechoslovakia adopted the Antimonopoly Act in January 1991. In 1994, the Slovak Republic, one of the successor States to the former Czechoslovakia, adopted a new Antimonopoly Act, which came into force on 1 August, 1994. Thereafter, on 27 February 2001, the Slovak Republic adopted the Protection of Competition Act No 136, amended in 2002 and 2004 to stay up to date with the latest changes of EU Competition law, and, in particular, those stemming from Regulation No 1/2003: modernization of the individual and block exemptions, introduction of commitment proceedings, modification of the sanction policy and of the leniency program. Another amendment to the Act was introduced by Act No 165 of 1 June 2009 which amended the leniency program provisions to better take into account the EU model. Further changes were brought by Act No 151/2014 of 14 May 2014 and its implementing decrees (on de minimis agreements, settlement, leniency and notification of concentrations) which came into force on 1 July 2014 and Act No 350/2016 of 29 November 2016 transposing EU Directive 2014/104 on damages actions into national law, which came into force on 27 December 2016.

The implementation of EU Directive- 2019/1 of 11 December 2018 to empower the competition authorities of the Member States to be more effective enforcers and to ensure the proper functioning of the internal market was the opportunity to restructure competition law in the Slovak Republic. Replacing the 2001 Act No 136 is the new Act No 187 on the Protection of Economic Competition ("the Act") which came into force on 1 June 2021.

Context

The Act No 187/2021 on Protection of Competition currently governing applies to all undertakings, regardless of their legal form, funding and legal existence, to include governement authorities, municipalities and regions (Article 2.1). Territorially, the Act extends to activities and conduct occuring in a foreign market “ if they result or may result in the restriction of competition in the territory of the Slovak Republic ” (Article 2.4).

Furthermore, some industries are subject to specific sectorial regulation. For instance, the Regulatory Office for Network Industries regulates network industries functioning under a monopoly to protect investors and consumers and is vested in its power by the Act No 250/2012 Coll. on Regulation in Network Industries. The Regulatory Authority for Electronic Communications and Postal Services has jurisdiction to issue pricing and regulation in the area of electronic communications based on Act No 139/2017 Coll. Amending Act No 351 on Electronic Communications.
