Article 5 of the Act defines a dominant position as a situation where one or more undertakings are not exposed to significant competition in a given market and where, due to their economic strenght, they can behave independently.

An undertaking considered dominant in a given market pursuant to Article 5 is abusing its dominant position in a set of situations provided by the Article, while the list is non exhaustive. Abuses listed include :

- Imposing unfair prices or trading conditions ;
