Scope

The foundation for Slovenia's competition law lays in Section 74 of the Slovenian Constitution, the third paragraph of which prohibits all practices that restrict competition in a manner contrary to law. Competition law in Slovenia is currently governed the Prevention of the Restriction of Competition Act ("the Act") adopted on 11 April 2008 (Official Gazette No 36/08). This new consolidated act seeks to align Slovenian law with EU provisions in this field and regulates the areas of restrictive agreements, abuse of dominance and concentrations. Unfair competition, until recently still governed by the provisions of the earlier Law on the Protection of Competition, is now covered by the Prevention of the Restriction of Competition Act (new Sections 63a and 63 b) by virtue of Act No 76/2015 which entered into force on 24 October 2015. However the Slovenian competition authority has not been granted jurisdiction to rule on unfair competition actions. On July 2012, amendments were brought to the Act in order to confer greater independence on the Slovenian authority. Thus in January 2013, the former Competition Protection Office (CPO) was reorganized and became the Competition Protection Agency (CPA). Finally, on 25 April 2017, the Act was amended in order to implement EU Directive No 2014/104 on damages actions for competition law infringements.

Context

The Act prohibits restrictive practices and abuses of a dominant position which prevent competition on the territory of Slovenia irrespective of where they occurred. It applies to undertakings which are defined as any entity engaged in economic activities, regardless of their legal and organizational form and ownership status. It also applies to associations of undertakings not directly engaged in an economic activity but which affect or may affect the behavior on the market of undertakings as defined. The competition rules also apply to public undertakings and other public law legal persons performing economic activities unless otherwise provided by law.

The Act does not apply to the relationship between employers and employees.
