658. Dominant position

Under Article 9 of the Act, abuse of a dominant position is prohibited. Like under EU law, dominance per se is not prohibited, merely its abuse. An undertaking is said to be in a dominant position when it is able to act to a significant degree independently of its clients, competitors and final consumers.
