In accordance with Article L. 650-1(1) of the Commercial Code, when a safeguard, receivership or liquidation procedure is opened, creditors cannot be held liable for any harm suffered as a result of the assistance granted, except in cases of fraud, gross interference in the management of the debtor, or if the guarantees given in compensation for the assistance are disproportionate to it.
