Obligations of the debtor

Article L. 622-13, II of the Commercial Code only allows the receiver to demand the performance of ongoing contracts if he is able to provide the promised performance to the debtor's co-contractor. The promised performance includes, in particular, the payment of the sums owed on their due date , all the necessary repairs, other than rent, under the lease agreement continued after the opening judgment , but also the cessation of the debtor's contractual failures .

The mere opening of the insolvency proceedings does not oblige the other party to resume performance of the work if the debtor does not remedy the defaults which justified their suspension . Nor can the receiver impose the reiteration by authenticated deed of a current sale contract if he does not pay the contracting party the price of the shares in question . Similarly, the continuation of a contract for the provision of hotel rooms, for which the co-contractor had invoked the exception of non-performance because the establishment did not comply with the specifications, cannot be required if the receiver does not justify any improvement in the hotel structure, nor the reconstitution of a sufficient and competent team of personnel to be able to provide the promised performance .
