The insurer, subrogated in the rights and actions of the insured whom it has indemnified, may avail itself of the declaration of claim made by the latter, before payment of the insurance indemnity, to the insolvency procedure of the tortfeasor . On the other hand, unless otherwise expressly or tacitly agreed, the insured is not entitled to declare the insurer's claim after having been indemnified by the latter .
