Where the property is no longer in the hands of the debtor in kind on the date of the claim, the owner may claim restitution in value. This is the case for a supplier who succeeds in proving that the equipment claimed existed in kind on the date on which the receivership procedure was opened, even though the receiver provides no explanation as to what has happened to it since that date .
