Referral procedures

The court that approved the plan may order its termination if the debtor does not fulfil its commitments within the timeframe set out in the plan, pursuant to Article L. 626-27, I of the Commercial Code, applicable to the receivership procedure by reference from Article L. 631-19. The matter may be referred to the court by a creditor, the commissioner for the enforcement of the plan or the public prosecutor .

The commissioner for the enforcement of the plan, who is required to report any failure to implement the plan to the president of the court and the public prosecutor and to inform the social and economic committee or, failing that, the staff representatives, may apply to the court to have the plan rescinded without prior formal notice . However, he may no longer apply to the court for the plan to be rescinded on the grounds that the debtor has failed to pay the wage claims after the last due date, as he is only appointed for the duration of the plan .
