Stretching of the suspect period

Article L. 632-2 of the Commercial Code  gives the court the power, rather than the obligation, to declare certain acts null and void if they have taken place since the date of cessation of payments , i.e. during the suspect period extending up to the opening judgment. In the event of a court-supervised liquidation, the suspect period extends from the date of cessation of payments to the judgment opening the receivership or liquidation proceedings.

Before declaring the nullity of assignments of claims made during the suspect period and the restitution of their amount, the court is obliged to ascertain whether they derive from an agreement for the assignment of professional claims entered into before the date of cessation of payments .

Article L. 632-1, II  also gives the court the power to annul free deeds transferring movable or immovable property and declarations of unseizability made in the six months preceding the date of cessation of payments. This text extends the suspect period beyond the date of cessation of payments. Consequently, a gift made a few weeks before the cessation of payments, when the debtor, put on notice by the bankruptcy judge, was unable to pay two monthly instalments under the plan, is null and void .
