Exceptions to the principle of public nature of proceedings

In non-contentious matters, Article 434 of the Code of Civil Procedure requires an examination of the application in chambers (Art. 11-1, para. 2, 1°, L. 72-626 of 5 July 1972, establishing an enforcement judge and relating to the reform of civil procedure). Failure to comply with the obligation to rule in chambers is sanctioned by invalidity, which, however, cannot be subsequently raised for non-compliance with these provisions if it is not invoked before the closure of the proceedings, nor can it be raised ex officio (Art. 446 CPC). This particularly concerns applications for annulment and rectification of civil status records (Art. 1050 CPC) or decisions in matters of educational assistance (Art. 1193 CPC).

Proceedings also take place in chambers in certain matters determined by decree, such as the status and capacity of persons, matters concerning private life, or those where publicity would infringe on the privacy of private life, or if all parties request it, or if disturbances arise that could disrupt the serenity of justice (Art. 11-1, para. 3, L. 72-626 of 5 July 1972, establishing an enforcement judge and relating to the reform of civil procedure and 435 Code of Civil Procedure), on pain of invalidity, which, however, cannot be subsequently raised for non-compliance with these provisions if it has not been invoked before the closure of proceedings, nor can it be raised ex officio (Art. 446 Code of Civil Procedure), or matters involving business secrecy under the conditions provided in 3° of Article L. 153-1 of the Commercial Code.
