If a private document produced during proceedings is alleged to be false, it will be examined in accordance with Articles 287 to 295 of the Code of Civil Procedure relating to the verification of documents requested as an incidental matter (Art. 299 CPC). In effect, it is for the judge to verify the disputed document, unless he or she can rule without taking it into account .

If a private document produced during proceedings is alleged to be false, it will be examined in accordance with Articles 287 to 295 of the Code of Civil Procedure relating to the verification of documents requested as an incidental matter (Art. 299 CPC). In effect, it is for the judge to verify the disputed document, unless he or she can rule without taking it into account .

Jurisdiction in matters of forgery claimed as an incidental issue has been the subject of doctrinal debate. Article 285 of the Code of Civil Procedure provides that the verification of private deeds falls within the jurisdiction of the court hearing the main proceedings when such verification is requested as an incidental matter. However, some legal scholars assert that incidental forgery claims are governed by the provisions of Article 286 of the same code, under which a forgery plea against an authentic instrument falls within the jurisdiction of the court hearing the main proceedings when raised incidentally before a judicial court or a court of appeal. In other cases, jurisdiction lies with the judicial court. Nevertheless, it appears that the reference made by Article 299 makes no such distinction, so that the court with jurisdiction over an incidental forgery claim concerning a private deed is the court seized of the main proceedings.
