Context

During the trial, a party may challenge the veracity of documentary evidence. The legislator distinguishes between private deeds and authentic instruments (Code of Civil Procedure, Art. 285 to 316). In the first case, it proceeds with the verification of writing. In the second, when the disputed instrument is found to be a forgery, it conducts forgery proceedings.

The verification of private deeds falls under the jurisdiction of the court seized of the main action when requested incidentally, and of the Judicial Court when requested as the main action (Art. 285 CPC). The registration of forgery against an authentic instrument falls under the jurisdiction of the court seized of the main action when filed incidentally before a Judicial Court or a Court of Appeal. In other cases, it falls under the jurisdiction of the Judicial Court (Art. 286 CPC).
