2. Proceedings before the Judicial Court and the Commercial Court

A copy of the submissions must be filed with the court registry. This filing is done either upon their notification with proof of their notification, or if this is prior to the initiation of proceedings, with the filing of a copy of the writ of summons (Art. 767 CPC). Filing of submissions at the court registry

A copy of the submissions must be filed with the court registry. This filing is done either upon their notification with proof of their notification, or if this is prior to the initiation of proceedings, with the filing of a copy of the writ of summons (Art. 767 CPC). Failure to file the copy of the submissions with the court registry only results in the inadmissibility of the submissions if a grievance is demonstrated .

The court registry records this submission by affixing the date and its endorsement on the copy and the original, the latter being returned immediately (Art. 769 CPC). The submissions, thus endorsed, are filed in the case file (Art. 727 CPC).

Furthermore, since the decree of 11 December 2019 , Article 850 of the Code of Civil Procedure provides that, under penalty of inadmissibility raised ex officio, procedural documents must be submitted to the court electronically within the framework of ordinary written proceedings and fixed-date procedure. However, when the document cannot be transmitted electronically for a reason beyond the control of the sender, it is prepared on paper and submitted to the court registry, according to the procedures provided in Article 769, or sent by registered letter with acknowledgment of receipt requested.
