As provided by Article L. 131-3 of the Code of Civil Enforcement Procedures, the penalty payment may be imposed and liquidated by the same judge if the latter has reserved that power. According to the Court of Cassation, such a combination does not violate the principle of impartiality set out in Article 6 § 1 ECHR .
