Pursuant to Article L. 131-2, para. 2, of the Code of Civil Enforcement Procedures, “the penalty payment is provisional or final.” Unless the court has decided otherwise, the penalty payment is by default provisional , allowing the court responsible for its liquidation to modify the amount.
