Article L. 153-1 of the Code of Civil Enforcement Procedures sanctions the State's refusal to assist in a measure of enforcement through an action for damages. Any decision of refusal by the competent authority must be justified . Failure to respond within a two-month period is equivalent to a refusal . This refusal is communicated to the creditor by the judicial commissioner .
