5. Civil Enforcement Procedures

A debtor who, without legitimate reason, evades his obligations may be compelled to fulfill them, if necessary under threat of a coercive fine, without prejudice to damages . Under the same conditions, the third party holding assets or funds of the debtor (garnishee) can also be ordered to pay the attachment of the seizure, without prejudice to recourse against the debtor .

Third-party evasion of obligations

A debtor who, without legitimate reason, evades his obligations may be compelled to fulfill them, if necessary under threat of a coercive fine, without prejudice to damages . Under the same conditions, the third party holding assets or funds of the debtor (garnishee) can also be ordered to pay the attachment of the seizure, without prejudice to recourse against the debtor .

Article R. 211-5 of the Code of Civil Enforcement Procedures allocates the applicable sanctions based on the breaches attributed to the third party. When, without legitimate reason, the garnishee fails to provide the required information, they risk paying the “causes of the seizure,” meaning the amounts owed to the creditor . However, when they provide inaccurate or false statements, they are only liable for damages. In this latter case, the court requires the establishment of a causal link between the fault and the alleged damage . A garnishee may be ordered to pay damages for failing to fulfill their duty to provide information, even if they owe no amount to the debtor .

The information that the third party is required to provide is mentioned in the seizure document and must be given immediately to the judicial commissioner .

The judicial commissioner responsible for immediately obtaining the necessary information from the garnishee must take particular care in conducting the questioning. Failing this, the garnishee has a legitimate reason not to respond or to respond with some delay .
