Original offense

As an after-the-fact offense (délit de conséquence) concealment or handling of unlawfully obtained items (recel) requires that the original offense be established , with the concealed goods necessarily originating from a prior crime or offense of which the beneficiary must have been aware . The original offense is thus the prerequisite for concealment .

It is not necessary for the circumstances of the original offense be determined  or for the perpetrator of the original offense be identified , nor prosecuted ro chatachterize the office of concealment. While the trial court's finding of the existence of the principal offense remains necessary, the possible acquittal of the perpetrator of the principal offense does not prevent the prosecution of the perpetrator of the concealment .

The principal offense and the offense of concealment are, in principle, incompatible, so that concealment cannot be enforced against the one who committed the original offense from which the concealed item originated . Even if the principal offense is time-barred, the perpetrator of the original offense cannot be prosecuted for concealment . However, the qualities of accomplice and co-perpetrator of the principal offense can be combined with that of the handler . Thus, the accomplice of an unlawful taking of interest can be prosecuted for concealment of that same offense , or the director of a company declared cumulatively guilty of complicity in breach of trust and concealment of the sums from that same offense .
