Directive No 2015/2436 now establishes non-use as defense in infringement proceedings. Article 17 provides that the proprietor of a trade mark can prohibit the use of a sign only to the extent that the proprietor's rights are not liable to be revoked (pursuant to Article 19) at the time the infringement action is brought.
