Principles

The anti-dumping procedure is aimed at penalizing unfair competition conditions which are mainly expressed by price discrimination between interchangeable products. Article 1 of Regulation No 2016/1036 thus sets forth:

"1. An anti-dumping duty may be applied to any dumped product whose release for free circulation in the Union causes injury. 

2. A product is to be considered as being dumped if its export price to the Union is less than a comparable price for the like product, in the ordinary course of trade, as established for the exporting country." 

Dumping is established if the products of a non-member country are introduced on the European market at a price lower than their normal value. Firstly, the Commission must determine which products are considered as being dumped and then search for like exported products. Trade protection measures will be adopted only if the price discrimination causes injury to Union industry and if it is the Union's interest that such measures be taken.
