Articles 101 and 102 TFEU apply to practices or behavior which “may affect trade between Member States”. The Commission has adopted guidelines on the effect on trade concept contained in Articles 101 and 102 of the Treaty , setting out the principles developed by the EU Courts and providing guidance on its application in frequently occurring situations.
