When a resolution falls partly within the competence of the ordinary general meeting and partly within that of the extraordinary general meeting, a mixed meeting may be convened to avoid having to successively call two separate meetings. No legislative provision governs the functioning of such a meeting. It is, in fact, a creation of practice. Depending on the resolutions in question, it is appropriate to observe the rules recommended for holding an ordinary or extraordinary general meeting .

Cass. com., 26 October 2010, LawLex202200005126JBJ, considering that Article L. 225-96 of the Commercial Code, which empowers the extraordinary general meeting of a public limited company to amend the statutes in all their provisions, does not require it to deliberate on the report of the board of directors for the purpose of the mixed general meeting, so that the absence of such a report is not likely to result in the annulment of this meeting.
