French Distribution Law

To take account of the specific characteristics of non-salaried management whilst affording it the benefit of a protective status, the Law of 3 July 1944 has clarified the situation with regard to employment law of non-salaried managers of branches of retail food businesses  by providing for the application of the provisions of the Law of 21 March 1941 on salaried management , subject to the specific provisions of managers of branches it lists. Those provisions have now been codified in Articles L. 7322-1 to L. 7322-6 of the Labor Code.

A national collective agreement of food businesses with branches, implementing Article L. 7322-3 of the Labor Code, was adopted on 18 July 1963  to fix the conditions that individual contracts of non-salaried managers of branches of retail food businesses must meet, in particular with regard to labor law (right to training, minimum pay, bonuses, rights to social security benefits, compensation for termination, inventory and statement of accounts, manager's liability for entrusted goods, opening hours, paid vacation, trade unions, etc.). It does not apply to non-salaried managing agents of branches of cooperative companies.

Currently codified at Articles L. 7321-1 to L. 7321-5 of the Labor Code.
