Opposition proceedings are closed if all opponents have withdrawn their opposition, if the patent is declared invalid by a judgment which has the force of res judicata, if the proprietor of the patent renounces the claims to which the opposition relates, or if the effects of the patent against which the opposition has been filed have ceased, unless the opponent can show a legitimate interest in obtaining a decision on the opposition. The INPI immediately notifies the parties of the decision to end the opposition proceedings. A record of the closing of proceedings is entered in the national patent register (Art. R. 613-44-12 IP Code).
