The proprietor of a design right may grant a license to exploit his or her right. The license may be of varying scope, particularly in terms of the rights granted or the geographical area covered. The license may be exclusive or non-exclusive. In accordance with the general conditions for the validity of agreements set out in Article 1128 of the Civil Code, the validity of the license is subject to the consent of the parties to the agreement, their capacity to act, and its lawful and certain content. A design licensing agreement constitutes a contract for the hire of things governed by Articles 1708 et seq. of the Civil Code.
