1. Ordinary Law of Civil Procedure

Pursuant to Article 32 of the Code of Civil Procedure, “any claim made by or against a person lacking the right to bring proceedings is inadmissible.” In other words, both the plaintiff and the defendant must have the right to bring proceedings. Standing can be defined as the “qualification to bring legal action required on pain of inadmissibility, for both the plaintiff and the defendant, which results either from the status required by law, in actions reserved for certain persons, or, in actions open to any interested party, from the justification of an interest”. Traditionally, several scenarios are distinguished. The first concerns the defense of individual interests personally or by authorized persons. The second pertains to the defense of a collective interest.
