2. Proceedings before the Judicial Court and the Commercial Court

By reference to Article 761 of the Code of Civil Procedure, the oral procedure applies to matters within the jurisdiction of the judge for the protection of contentious matters, to the matters listed in Articles R. 211-3-13 to R. 211-3-16, R. 211-3-18 to R. 211-3-21, and R. 211-3-23 of the Code of Judicial Organization, as well as in Table IV-II annexed to the Code of Judicial Organization, and, excluding matters within the exclusive jurisdiction of the Judicial Court, when the claim involves an amount less than or equal to EUR 10,000 or concerns an undetermined claim originating from the performance of an obligation whose amount does not exceed EUR 10,000.

For the purpose of simplifying civil procedure, the court action is now initiated either by a writ of summons or by an application submitted or sent jointly by the parties (Art. 818, para. 1, CPC) . It can also be initiated by a unilateral application when the amount of the claim does not exceed 5,000 euros, or when it is made for the purpose of a preliminary attempt at conciliation, or when the law or regulation provides for it (Art. 818, para. 2, CPC).
