2. Proceedings before the Judicial Court and the Commercial Court

Under Article 775 of the Code of Civil Procedure, proceedings before the Judicial Court are generally in writing. However, when the parties are exempt from instructing counsel in accordance with the provisions of Article 761 , the proceedings are oral, subject to specific provisions applicable to the matters concerned (Art. 816 CPC).

Procedure before the Judicial Court

Under Article 775 of the Code of Civil Procedure, proceedings before the Judicial Court are generally in writing. However, when the parties are exempt from instructing counsel in accordance with the provisions of Article 761 , the proceedings are oral, subject to specific provisions applicable to the matters concerned (Art. 816 CPC).

The Code of Civil Procedure provides the common provisions for all procedures applicable before the Judicial Court in Articles 750 to 774-4, before specifying the implementation of written procedures—ordinary contentious, non-contentious, or single-judge—in Articles 775 to 816, then oral procedures—ordinary, interim, or expedited on the merits—in Articles 817 to 839, and finally other procedures—fixed-date, ex parte, or on referral from the criminal court—in Articles 840 to 847.

Art. 761 CPC: "The parties are exempt from instructing counsel in cases provided for by law or regulation and in the following cases:
1° In matters within the jurisdiction of the judge for the protection of litigation;
2° In matters listed in Articles R. 211-3-13 to R. 211-3-16, R. 211-3-18 to R. 211-3-21, R. 211-3-23 of the Code of Judicial Organization and in matters listed in Table IV-II annexed to the Code of Judicial Organization;
3° Excluding matters within the exclusive jurisdiction of the Judicial Court, when the claim involves an amount less than or equal to 10,000 euros or concerns an undetermined claim originating from the performance of an obligation whose amount does not exceed EUR10,000  (...)."
