The licensor must indemnify the licensee against any defects affecting the validity of the design, insofar as Article 1721 of the Civil Code requires the licensor to indemnify the licensee against any defects preventing use of the title. As the validity of the title is a condition of the validity of the license agreement, terms prohibiting the other party from contesting the validity of the registration are null and void.

Under Article 1719 of the Civil Code, the licensor must also undertake to ensure that the licensee's peaceful enjoyment of the title is not disturbed by his or her own actions or those of a third party.
