2. Proceedings before the Judicial Court and the Commercial Court

In the context of a principal claim falling within its subject-matter or territorial jurisdiction, the Judicial Court may be required to examine defenses, incidental claims, or procedural incidents that exceed its initial jurisdiction. Furthermore, the parties to a contract may, under certain conditions, derogate from the rules of subject-matter and territorial jurisdiction and thus designate the competent court to settle their future disputes.

These extensions of jurisdiction, whether provided by law or established by agreement, allow the Judicial Court to broaden its jurisdiction to matters that were not initially assigned to it.
