La participation de commerçants à des loteries de bienfaisance et la publicité en résultant n'affectent pas la légalité de la loterie, dès lors que le produit du jeu est reversé à l'association organisatrice dans un but exclusivement social.

La circonstance que les commerçants de l'arrondissement aient créé et alimenté un fonds commun pour financer l'achat des lots et émis des bons de participation ouvrant droit concurremment avec la vente directe, à la remise de billets, est sans influence sur la légalité des arrêtés préfectoraux autorisant des loteries de bienfaisance.

L'infraction aux articles L. 322-1 et L. 322-2 du Code de la sécurité intérieure constitue un délit contraventionnel caractérisé du seul fait de l'organisation en connaissance de cause d'une loterie prohibée.

La participation à un jeu de hasard déclenchée par le dépôt d'une pièce de monnaie dans un appareil constitue une loterie illicite, même si chaque joueur a l'assurance d'obtenir un lot de consolation.

The fact that an internal taxation system is incompatible with EU law beyond a certain amount does not necessary result in its nullity, since the national court may decide, according to the rules of its national law, whether the illegality affects the whole tax or only so much of it as exceeds that amount.

Although Article 110(2) TFEU, which lays down a straightforward prohibition against protection of national productions, which is unconditional and with no action being required for its implementation or its entry into force, either on the part of the institutions of the Union or the Member States, involves the evaluation of economic factors, this does not exclude the right and duty of national courts to ensure that the rules of the Treaty are observed whenever they can ascertain that the conditions necessary for the application of that article are fulfilled.

If there is no direct competition of any sort with a domestic product, there is indirect taxation where the imported product bears a specific fiscal charge because of its state of manufacture or distribution or because of any other economic circumstance, in such a way as to protect certain activities distinct from those used in the manufacture of the imported product.

Article 110 TFEU prohibits not only the imposition of any internal taxation which imposes a higher charge on an imported product than on domestic ones competing with the imported product, although they are not similar, but also, in the absence of direct competition, any internal taxation which subjects the imported product to a specific fiscal charge in such a way as to protect certain activities distinct from those used in the manufacture of the imported product.

Similarity between products within the meaning of Article 110 TFEU exists where the products come within the same fiscal, customs or statistical classification.

The taxation is of such a nature as to afford indirect protection the domestic production where it imposes a heavier burden on an imported product than on a domestic product with which the imported product is, by reason of one or more economic uses, in competition even though the condition of similarity for the purposes of the first paragraph of Article 110 TFEU is not fulfilled.

Although Article 110 TFEU prohibits Member States from imposing any internal taxation on imported products in excess of that imposed on similar domestic products, or of such a nature as to afford indirect protection to other domestic products, it does not prohibit the imposition of any internal taxation on imported goods which do not compete with domestic products.

One and the same tax cannot be both a measure having an equivalent effect to a quantitative restriction on imports and internal taxation.

L'incompatibilité d'un régime d'imposition intérieure, au-delà d'un certain montant, avec le droit européen, n'entraîne pas nécessairement sa nullité, le juge national pouvant décider, selon les règles de son droit national, si cette illégalité affecte l'imposition dans son intégralité ou seulement dans la mesure où elle dépasse le montant en cause.

A défaut de toute concurrence directe avec un produit national, il y a imposition indirecte si le produit importé supporte une charge fiscale particulière à raison de son état de fabrication ou de commercialisation, ou de toute autre circonstance économique, de manière à protéger certaines activités distinctes de celles qui ont servi à la fabrication du produit importé.

L'article 110 TFUE prohibe non seulement la perception de toute imposition intérieure frappant un produit importé plus lourdement qu'un produit national non similaire mais en concurrence avec lui, mais aussi, en l'absence de concurrence directe, toute imposition intérieure faisant supporter au produit importé une charge fiscale particulière de manière à protéger certaines activités distinctes de celles qui ont servi à la fabrication du produit importé.

Le rapport de similitude visé à l'article 110 TFUE existe lorsque les produits tombent sous la même classification fiscale, douanière ou statistique.

L'imposition est susceptible de protéger indirectement une production nationale lorsqu'elle frappe plus lourdement un produit importé qu'un produit national avec lequel le premier se trouve en concurrence, en raison d'une ou de plusieurs utilisations économiques, sans remplir cependant la condition de similitude de l'article 110 TFUE, paragraphe 1.

Si l'article 110 TFUE interdit à tout Etat membre de frapper les produits importés d'impositions intérieures supérieures à celles frappant les produits nationaux similaires ou de nature à protéger indirectement d'autres productions nationales, il ne prohibe pas les impositions intérieures pour les marchandises importées qui ne concurrencent pas un produit national.

Si l'article 110 TFUE, paragraphe 2, qui énonce une interdiction pure et simple de protection des productions nationales, qui n'est assortie d'aucune condition ni subordonnée, dans son exécution ou dans ses effets, à l'intervention d'aucun acte, soit des institutions de l'UE, soit des Etats membres, comporte des éléments relevant de l'appréciation de faits économiques, cette circonstance n'exclut pas l'obligation du juge national d'assurer le respect des règles du Traité lorsque les conditions d'application de ce texte sont remplies.

Une taxe ne peut constituer à la fois une mesure d'effet équivalent à une restriction quantitative aux importations et une imposition intérieure.

From among the various procedures available under national law, national courts may apply those which are the more appropriate for the purpose of protecting individual rights conferred by EU law.

The provisions of the Treaty which require the interposition between the rule of the Union and its implementation of legal acts implying discretion in favor of the Member States, cannot confer rights on individuals on which they may directly rely before the national courts.

The fact that Article 110(1) TFEU describes the Member States as being subject to the obligation it imposes does not exclude that individuals can directly benefit from it.

Article 110(1) TFEU which lays down an obligation which is not qualified by any condition, or subject, in its implementation, to the taking of any measure either by the institutions of the Union or by the Member States, produces direct effects on the legal relationships between Member States and persons within their jurisdiction.

The terms 'directly or indirectly' in Article 110(1) TFEU refer to all taxation which is actually and specifically imposed on the domestic product at all earlier stages of its manufacture and marketing or which corresponds to the stage at which the product is imported from other Member States, the effect of this taxation diminishing in proportion as the previous stages of manufacture and marketing become more remote and being rapidly negligible.

Where internal taxation is only incompatible with Article 110 TFEU beyond a certain amount, it is for the national court to decide, according to the rules of its national law, whether this illegality affects the taxation as a whole or only inasmuch as exceeds that amount.

Les dispositions du traité qui impliquent une interposition, entre la règle européenne et son application, d'actes juridiques comportant un pouvoir d'appréciation au profit des Etats membres, ne sauraient conférer aux particuliers des droits individuels directement invocables devant les juridictions nationales.

Les termes "directement ou indirectement" énoncés à l'article 110 TFUE, alinéa 1, visent l'ensemble des impositions qui grèvent effectivement et spécifiquement le produit national, à tous les stades de sa fabrication et de sa commercialisation antérieurs ou concomitants au stade de l'importation du produit en provenance d'autres Etats membres, l'incidence de ces impositions étant d'autant plus réduite, les stades de fabrication et de commercialisation antérieurs sont éloignés et ayant tendance à devenir rapidement négligeable.

Lorsqu'une imposition intérieure n'est incompatible avec l'article 110 TFUE, qu'au-delà d'un certain montant, il appartient à la juridiction nationale de décider, selon les règles nationales, si cette illégalité affecte l'imposition en son entier ou seulement dans la mesure où elle dépasse ce montant.

Le fait que l'article 110 TFUE, alinéa 1, désigne les Etats membres comme sujets de l'obligation qu'il impose n'exclut pas que les particuliers puissent en être immédiatement les bénéficiaires.

Les juridictions nationales peuvent appliquer, parmi les différents procédés offerts par leur ordre juridique interne, ceux qui sont les plus aptes à sauvegarder les droits individuels conférés par le droit européen. 

L'article 110 TFUE, alinéa 1, qui pose une obligation qui n'est assortie d'aucune condition ni subordonnée, dans son exécution, à l'intervention d'aucun acte, soit des institutions de l'UE, soit des Etats membres, produit un effet direct dans les relations juridiques entre ces derniers et leurs justiciables.
